FXNET INTERNET SERVICE TERMS AND CONDITIONS

By subscribing to any FXNET Internet Service, the subscriber agrees to the following Terms and Conditions:
1. SERVICE AVAILABILITY
FXNET shall provide internet service based on network availability and technical feasibility within the service area.
Service installation is subject to:
- Site survey and validation
- Available network capacity
- Acceptable signal and fiber readings
- Compliance with installation requirements
FXNET reserves the right to decline applications that do not meet technical requirements.
2. SUBSCRIPTION PLANS
The subscriber agrees to the selected internet plan and corresponding monthly fee.
Current plans and rates may be updated without prior notice as market and operational conditions require.
Any promotional offer may have separate terms and conditions.
3. FAIR AND LEGAL USE
The subscriber agrees not to use the service for:
- Illegal activities
- Cybercrime
- Network attacks
- Distribution of malware or viruses
- Unauthorized access to systems or networks
- Activities prohibited under Philippine laws and regulations
FXNET reserves the right to suspend or terminate service for violations.
4. EQUIPMENT RESPONSIBILITY
Any ONU, modem, router, or equipment provided by FXNET remains the property of FXNET unless otherwise stated.
The subscriber shall be responsible for:
- Loss
- Theft
- Physical damage
- Unauthorized modifications
Replacement costs may apply.
5. INSTALLATION
Installation fees, if applicable, must be paid according to the agreed terms.
The subscriber grants FXNET personnel reasonable access to the premises for installation, repair, maintenance, or equipment retrieval.
6. SERVICE INTERRUPTION
While FXNET strives to maintain reliable service, interruptions may occur due to:
- Fiber cuts
- Power outages
- Natural disasters
- Equipment failure
- Third-party provider outages
- Force majeure events
FXNET shall not be liable for business losses, loss of income, or indirect damages arising from service interruptions.
7. TECHNICAL SUPPORT
Subscribers may report service issues through official FXNET communication channels.
Support requests shall be handled according to priority and operational availability.
Repair schedules may vary depending on:
- Severity of the issue
- Location
- Weather conditions
- Network accessibility
8. ACCOUNT SHARING
Residential subscriptions are intended for household use only.
The subscriber shall not:
- Resell internet service
- Redistribute service outside the registered premises
- Operate as a sub-provider without written authorization from FXNET
Violation may result in immediate suspension or termination.
9. BILLING AND PAYMENTS
For Prepaid Plans
- Service remains active while subscription is valid.
- Failure to renew will result in automatic service suspension.
For Postpaid Plans
- Bills must be paid on or before the due date.
- Late payments may result in temporary suspension.
FXNET reserves the right to impose reconnection fees where applicable.
10. DISCONNECTION
FXNET may disconnect service for:
- Non-payment
- Fraudulent activities
- Violation of Terms and Conditions
- Unauthorized network modifications
- Abuse of service
11. VOLUNTARY TERMINATION
Subscribers requesting termination must settle all outstanding balances before service disconnection.
FXNET-owned equipment must be returned in good condition.
Applicable pullout fees may apply.
12. PRIVACY AND DATA PROTECTION
FXNET respects subscriber privacy and shall handle personal information in accordance with the Philippine Data Privacy Act of 2012 (RA 10173).
Subscriber information shall only be used for:
- Account management
- Technical support
- Billing purposes
- Regulatory compliance
FXNET shall not sell subscriber information to third parties.
13. NETWORK MANAGEMENT
FXNET may implement reasonable network management measures to ensure overall network stability, security, and quality of service.
Such measures may include:
- Traffic engineering
- Security filtering
- Abuse prevention
- Maintenance activities
14. LIMITATION OF LIABILITY
FXNET's liability shall be limited to the amount paid by the subscriber for the affected service period.
FXNET shall not be liable for:
- Loss of profits
- Loss of business
- Data loss
- Indirect or consequential damages
15. AMENDMENTS
FXNET reserves the right to modify these Terms and Conditions at any time.
Updated versions shall be published through official communication channels and the FXNET website.
